In general, workers are not allowed to file personal injury claims against their employer for an accident caused by their employer or a co-worker and so their recovery is limited to workers' compensation. However, maritime workers are protected under the Jones Act, which gives them unique recovery options including the right to maintenance and cure.

Under the Jones Act, maritime workers have the right to a trial by jury for injuries sustained in accidents involving the negligence of ship owners, ship captains and co-workers. In order to qualify for protection under the Jones Act, a worker must spend at least 30 percent of his or her employment in the furtherance of a vessel in navigation.
