DUI/DWI in the State of Arizona
Getting a DUI or DWI in the State of Arizona is very serious business. If you have a blood alcohol or drug level of just .149 or less and are caught driving even just a few inches, you can face serious consequences. The penalties may include
- Fines and surcharges

- Attending mandatory classes

- Revoking your driving privileges
- Having to blow into a device before you can drive your car

Regular DUI or DWI First Offense
If you have been convicted of a DUI in Scottsdale for the first time ever, or for the first time in the past seven (7) years, it would be considered a first offense regular DUI or non-extreme DUI or DWI. The surcharge and minimum fine would cost you approximately $1,537.
Consequently, the penalties are a mandatory 10 days in jail at a minimum, however, if you attend a mandatory alcohol screening (approximate cost is $50,) than upon completion, 9 days can be suspended. Hence, you can also face — up to a maximum of six (6) months — jail time. Other classes that are recommended cost approximately $500.
In addition, it is also mandatory for the court to order that an Ignition Interlock Device (IID) be attached to the steering wheel of your car for one (1) year, which you will be required to blow into each time you start your vehicle, and then every additional 15 minutes after that in order to keep the ignition running. Thus, in severe cases, the court can choose to order that the IID stays on your vehicle for over twelve (12) months.
Regular DUI 0r DWI Second Conviction
If within seven (7) years of the first DUI/DWI, you are convicted a second time for a non-extreme DUI or DWI, the minimum surcharge and fine would be approximately $3,500.
A minimum of at least 90 days jail time is a mandatory penalty, although that time can be reduced by a 60-day suspension, upon completing a mandatory alcohol-screening program.
Your driving privileges will also be revoked for at least one year by the MVD (Motor Vehicle Department), you will be required to do 30 hours of community service, and have an IID attached to your steering wheel for a mandatory one year, which will also cost you approximately $1,200.
Even worse, at his/her discretion, the prosecutor can charge you with a first offense felony of a third offense misdemeanor or aggravated DUI, and most times, they do!
Regular DUI 0r DWI Third Offense
If you are caught driving under the influence of drugs or alcohol a third time within seven years of another conviction, you will find yourself in a heap of trouble. The term used is a “misnomer” since you will be charged with an aggravated DUI, which is a first offense felony and the mandatory penalty for this is a minimum of four months jail time. At times, the court will choose to charge you with a misdemeanor rather than a third offense DUI felony. If the two charges you had prior are alleged by the court, they will give you 180 days in prison.
